1. INTRODUCTION
This policy applies to End-Users and Issuers of any Kaskade products or services (referred to in this policy as “the Service”) and explains how we protect personal information made available to us. The terms “End-User” or “Issuer” refer to you, the person making use of any Kaskade products or services or issuing any Kaskade certificates or seals. The terms “we” or “our” refers to Kaskade.
For purposes of this policy, “personal information” means any information identifying and describing an identifiable individual, including, but not limited to information relating to their name, age, gender, reproductive status, marital status, national, ethnic or social origin, sexual orientation, physical or mental health, disability, conscience, belief, culture, language and birth of the individual; educational, criminal or employment history of the individual, financial status or information relating to financial transactions in which they have been involved and any identifying number, address or contact information of the individual This policy may be updated from time to time at our discretion and changes will become effective upon posting to the site. We are committed to maintaining the confidentiality, integrity and security of your personal information and we will take all appropriate technical and organisational security measures to ensure that where any personal information is provided to us it will be protected against loss, destruction and damage, and against unauthorised or accidental access, processing, erasure, transfer, use, modification, disclosure or other misuse.
2. USE OF PERSONAL INFORMATION
In respect of personal information we will comply with any lawful request or direction made or given by any of your authorised representatives in relation to personal data, use personal information only for the purposes of fulfilling our obligations and to comply with the lawful instructions of personal data subjects from time to time in connection with their personal information, will not retain personal information for any longer than is necessary for these purposes, will not disclose personal information without a data subject’s written authority (except for the purposes of fulfilling our obligations), and will immediately notify a data subject if we become aware that a disclosure of personal information may be required by law. Unless expressly provided for to the contrary, you consent and agree to us, and our authorised service providers, caching data and other information, including personal information, in the memory of any software system we make available to you and/or your authorised End-Users for up to 30 days.
3. USAGE DATA
You recognise and agree that when you access or use any Kaskade software or system, we may collect technical and other user data, including the type and version of operating system and browser used, Internet protocol addresses, the website pages visited and the time spent on the Kaskade website. This data may be used, for example, to identify software compatibility issues, or it may be analyzed to improve our website design. We may also detect and log an End-User’s location in order to identify your geographic region or time zone for routing traffic to geographically based servers or for managing time-sensitive tasks like the sending of notifications.
We may gather additional data using cookie technology. “Cookies” are files that are stored by your browser on your computer’s hard drive. Cookies may be used, for example, to limit the amount of times an End-User sees a particular notice or to help remember personal settings and preferences. If an End-User blocks cookies from being stored on a computer, the functionality of the software may be negatively affected. Kaskade, or third party service providers acting on our behalf, may use the technical and other user data we collect to analyze and improve our website design, the functionality, speed or responsiveness of the software and to help us measure the performance of our online advertising campaigns.
4. ANONYMOUS AND AGGREGATED DATA
Kaskade may process and disclose anonymous or aggregated personal information to third parties, including in relation to End-Users. This information will not identify End-Users individually.
5. APPLICATION PROGRAMMING INTERFACES
Where, for the purpose of providing the Services to you, any Kaskade software or bespoke intellectual property acts as an Application Programming Interface (“API”) for the purpose of specifying how different software systems should interact with each other, or where for that same purpose Kaskade software interacts with other API’s, including third party API’s, we may pass and retrieve data, including personal information, between the different software systems and third parties that interact via those API’s.
6. ENCRYPTION AND SECURITY
When you login to access controlled components of the Service or submit sensitive information on our web forms, all communications between your computer and Kaskade’s servers are encrypted using secure socket layer technology (SSL) to prevent unauthorized interception of your personal and confidential information. You are responsible for maintaining the confidentiality of your login details and passwords. We recommend using secure combinations of lower case and upper case alphabetic, numeric and special characters that are not easy to guess and avoid any use of passwords that make use of your name, date of birth, other significant dates or your identity number and that you change your password periodically. You must not provide your account credentials to any third party. If you suspect they have become known to anyone else, you must notify us, or your Issuer, immediately. We shall have no liability to you where you fail to keep your login details or password secure.
7. THIRD PARTIES
Where we make use of third party service providers to help us provide services to you, including for the purposes of retrieving or delivering information, records, notifications or other messages to you or your End-Users or for hosting or providing any component of our services to you, we require such third parties to maintain the confidentiality of any personal information we provide to them for these purposes. Some of these third parties may be situated outside of your country and you consent to your personal data and that of your End-Users being transferred cross-border so that Kaskade can provide or enable the requested services to you. In this regard, we engage only with reputed third party service providers who have security and privacy policies and procedures providing at least the same level of protection as we do ourselves.
8. DISPLAY OF INFORMATION WITHIN Kaskade CERTIFICATES
Some of our products and services, including website certificates, seals and other software outputs are designed to display information regarding the identity of website owners and operators to visitors of those websites. Where you make use of any of those products you consent to the public display of that information. If any certificate or seal is cancelled or revoked, the fact of that cancellation or revocation will be accessible to persons who view the cancelled or revoked certificate or seal.
9. CHANGE OF CONTROL
If Kaskade merges with, or is acquired by, any other business, you will be notified and any personal information that we hold about you will become available to that other business but only in terms of the detailed terms and conditions of this privacy policy.
10. TERMINATION OF RELATIONSHIP
If you terminate your relationship with Kaskade, we will delete your personal information from our active production servers. However, portions of your personal information may be retained in back-ups and archives for an indefinite period to assist us in meeting our legal compliance obligations. We may also continue to use anonymous or aggregated data for an indefinite period to analyse and improve the Service.
11. COMMUNICATIONS WITH YOU
We communicate with our customers by email and other messaging applications. You may opt out from promotional communications from us that are not strictly related to the provision of the Service to you. Whenever you use the Service, contact us electronically, import data or use any of the facilities offered by us or any affiliated party, we may collect, record and process your personal information. Where information about you or your End-Users that you have authorised a social media platform to share with us is governed by the privacy policies of that platform, we shall only process and retain such information as we are permitted to in terms of those policies or in accordance with the express permission that you may give us.
12. PERSONAL INFORMATION OF MINORS
We do not knowingly collect personal identifiable information from anyone who is a minor. If it is discovered that we have collected personally identifiable information from a minor, we will delete that information immediately.
